Terms & Conditions
The client agreement between Cre8 My Site and the businesses we build for. Read the whole thing here, before money is ever discussed — when you're ready to start, we send you this same agreement with your plan and pricing filled in, to sign properly.
This contract ("Agreement") is entered into between Cre8 My Site ("Company") and the undersigned client ("Client"). By signing this Agreement, Client agrees to the following terms and conditions.
To be completely honest, we hate that we must post any terms of service or "fine print" at all. We are an old-fashioned local company with old-fashioned values. We care about the local business owner and believe giving your word and a handshake should still be enough to build trust.
Be fair to us and we will be fair to you. That's all this is.
Electronic Signature AcknowledgmentE-Sign Act compliance
By submitting this form and providing your electronic signature, you acknowledge and agree that your electronic signature is legally binding and carries the same weight and legal effect as a handwritten signature.
This Agreement is entered into electronically in accordance with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001 et seq.) and applicable Louisiana state law.
You confirm that you have read, understood, and voluntarily agreed to all terms, that you have the legal authority to enter into this Agreement, and that you intend your electronic signature to serve as your binding acceptance.

- Hosting (through our website platform)
- Security (through our website platform)
- Website updates (hours based on your plan, or flat rate if self-hosted)

- Accessibility care (Cre8 Essentials and Cre8 Growth plans only), as described in the Accessibility & the ADA section
Disclaimer of WarrantiesNo guaranteed results
We genuinely put our heart into everything we build. That said, all services are delivered on an "as-is" and "as-available" basis. We make no guarantees regarding traffic volume, lead generation, conversion rates, revenue increases, or search engine rankings, and we make no representation or warranty that any website, content, or service complies with the Americans with Disabilities Act (ADA), the Web Content Accessibility Guidelines (WCAG), any privacy law, or any other law, regulation, or standard.
If anyone — us included — ever promises you a guaranteed spot on page one of Google, please don't just walk away... run.
We will always give you our best effort, but we cannot promise specific results because too many factors are outside our control, including search engine algorithm changes, market conditions, and your industry's competitive landscape.
Limitation of LiabilityWhere our responsibility begins and ends
To the fullest extent permitted by law, Cre8 My Site's total cumulative liability for any and all claims shall not exceed the total amount of fees paid by the Client during the 30 days immediately preceding the event giving rise to the claim.
In no event shall Cre8 My Site be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, loss of data, business interruption, or reputational harm.
This limitation applies regardless of how the claim arises and survives termination of this Agreement.
Payment TermsAuto-pay, invoicing & late fees
Monthly auto-payments begin on your website launch date and recur on the same calendar day each month. All payments are processed securely through a third-party processor (Stripe/PayPal) — we never store your card info.
If a payment fails, our processor will retry up to 3 times over 3 days. If still unsuccessful:
- All services including hosting and marketing campaigns may be suspended immediately
- Updated billing info and full outstanding balance required before reinstatement
For monthly invoicing clients:
- Invoices issued the 1st, due by the 7th of each month
- Late fee: $35 or 10% of the overdue amount (whichever is greater)
- Services suspended immediately upon non-payment
Non-payment may result in permanent removal of your website and referral to a collections agency.
RevisionsWhat's included after launch
Upon completion, you are entitled to one (1) round of revisions. A revision is defined as changes limited to:
- Existing text content
- Image swaps
- Color adjustments
- Minor cosmetic modifications
Revisions do NOT include new pages, new sections, structural layout changes, custom coding, or changes requiring more than 2 hours of work. Additional fees apply for out-of-scope requests.
Client Delay PolicyKeep projects moving forward
If Cre8 My Site is waiting on materials, approvals, content, or feedback and the Client does not respond within 14 calendar days, the project timeline will be extended accordingly.
If a project stalls for 30 days or more due to Client inactivity, Cre8 My Site reserves the right to:
- Place the project in a queue and reprioritize active clients
- Assess a project restart fee before resuming work
Monthly billing continues uninterrupted regardless of project delays caused by Client inactivity.
Copyright & TrademarkYour content, your responsibility
The Client unconditionally guarantees that any text, graphics, photos, designs, trademarks, or artwork furnished to Cre8 My Site are owned by the Client or used with permission from the rightful owner.
Cre8 My Site cannot be held responsible for any trademark, copyright, or IP infringement. If a claim is made, we will have no choice but to remove the content in question until the Client can provide proof of ownership.
Ownership & Intellectual PropertyWho owns your website
The website and all associated intellectual property will be owned by the Client. However, because Cre8 My Site does not charge a standard upfront design fee, the Client must remain a customer for a minimum of twelve (12) months on the Cre8 Basics plan, or six (6) months on the Cre8 Essentials and Cre8 Growth plans, before transferring the website to another provider.
After that minimum term, no Export Fee will be charged and Cre8 My Site will provide all available files and code at no additional cost.
The Client acknowledges the website is built on a CMS (content management system) and that exported code may require a developer to function correctly on another platform. Cre8 My Site will not support third-party developers after transfer.
ConfidentialityWhat stays between us
Both parties agree to maintain confidentiality of each other's proprietary information.
- The Client agrees not to disclose Cre8 My Site's tactics, pricing, software, tools, or sensitive business information to third parties
- Cre8 My Site agrees not to share any details about the Client or their business with anyone outside of Cre8 My Site, its partners, or contractors
TerminationHow to cancel services
To cancel services, the Client must provide 30 days' written notice via email to:
Termination does not relieve the Client of any outstanding balances owed to Cre8 My Site.
Dispute ResolutionHow we handle disagreements
We genuinely hope we never have to use this section. A simple honest conversation is all it usually takes. But if needed, both parties agree to this process:
- Direct Communication — Written notice of the dispute with 30 days to resolve through good-faith communication.
- Mediation — Non-binding mediation with a mutually agreed-upon mediator in Tangipahoa Parish, Louisiana.
- Binding Arbitration — Administered in Tangipahoa Parish per AAA rules. The arbitrator's decision is final and binding.
All claims must be brought on an individual basis, no class actions.
Force MajeureThings beyond anyone's control
Neither party shall be held in breach or liable for any delay arising from causes beyond their reasonable control, including:
- Acts of God, natural disasters, hurricanes, floods, fire
- Pandemics or government-mandated shutdowns
- Cyberattacks on third-party infrastructure
- Internet or power outages
- Platform outages (CMS, Stripe, PayPal, etc.)
Monthly billing obligations remain in effect during a force majeure event unless both parties agree otherwise in writing.
Client ResponsibilitiesWhat we ask of you
At Cre8 My Site, you can expect to be treated with the respect and kindness you deserve. We ask for the same in return. A few things we don't do:
- We don't work for free
- We don't perform miracles
- We don't solve problems for free that you've created
- We don't guarantee specific results
- We never speak negatively about our clients or partners
As a Client, we ask that you:
- Keep pricing discussions private
- Treat our team with respect at all times
- Maintain a positive image of Cre8 My Site publicly
- Communicate in a timely manner to prevent project delays
Any negative, rude, or defamatory comments toward our team will result in immediate termination of services with no refunds.
Third-Party SoftwarePlatforms we use to serve you
Cre8 My Site uses third-party platforms to complete your requested services, including hosting, privacy and consent, analytics, form, booking, payment, and chat tools. The Client agrees to hold Cre8 My Site harmless should any issues arise with these platforms, including downtime or loss of income.
Cre8 My Site cannot control the performance of third-party platforms and is simply utilizing their services to help you. You may request vendor information and communicate directly with any platform involved in an issue.
Privacy Policies & ConsentYour legal responsibilities
Cre8 Essentials and Cre8 Growth plans include a privacy policy, terms of service, disclaimer, and cookie consent tool, provided through our partner Termageddon or another provider Cre8 My Site selects, and set up by Cre8 My Site. Speaking directly with the provider about your business’s specific needs is recommended.
Cre8 Basics does not include these tools. Basics Clients must obtain their own privacy policy and consent tools, and Cre8 My Site will install embed code the Client provides at no charge.
On every plan, the Client is solely responsible for ensuring that its website’s policies, cookie consent, and data practices comply with all applicable privacy laws, and for the accuracy and completeness of the information the Client gives any policy provider. Cre8 My Site is not a law firm and does not provide legal advice. A privacy attorney is strongly recommended.
Accessibility & the ADAWhat we do, and what stays with you
Cre8 My Site designs and builds websites with the goal of meeting the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA, and checks each new website against that standard with automated testing and a manual keyboard review before launch. This is a design goal and a good-faith practice. It is not a guarantee.
The law on website accessibility is unsettled. The ADA does not set a technical standard for private business websites, courts do not all agree on what it requires, and no tool, widget, audit, or developer can certify that a website is compliant. Accordingly, the Client understands and agrees that:
- Cre8 My Site makes no representation or warranty that the Client’s website is, or will remain, compliant with the ADA, WCAG, Section 508, or any other federal, state, or local accessibility law, regulation, or standard.
- The Client is solely responsible for determining which accessibility laws apply to its business and for its website’s compliance with them.
- The Client is responsible for the accessibility of all content it supplies, adds, approves, or changes, including text, images and their descriptions, documents such as PDFs, audio, video, captions and transcripts, and color and design choices it requests.
- The Client is responsible for the accessibility of third-party tools used on its website, including booking, scheduling, payment, chat, review, social media, and consent tools, whether added by the Client or by Cre8 My Site at the Client’s request.
- A website’s accessibility can change after launch as content, browsers, assistive technologies, and third-party tools change. Ongoing testing, monitoring, and remediation are the Client’s responsibility, except for work expressly included in the Client’s plan.
- Cre8 My Site does not provide legal advice. The Client is strongly encouraged to obtain an independent accessibility audit and advice from a qualified attorney.
Accessibility care (Cre8 Essentials and Cre8 Growth plans). On these plans, Cre8 My Site will (a) publish an accessibility statement page on the Client’s website with a way for visitors to report problems; (b) check the website for accessibility issues once every twelve (12) months and send the Client a short written summary; and (c) within a reasonable time, correct accessibility issues it identifies, or that are reported to it, in code written by Cre8 My Site. Issues found in Client content or third-party tools will be reported to the Client for the Client to resolve. Accessibility care is a limited, good-faith maintenance service. It is not an audit, a certification, or a guarantee of compliance, and the statement page is published on the Client’s behalf, based on information the Client provides.
Accessibility complaints and claims. The Client must notify Cre8 My Site in writing within five (5) business days of receiving any complaint, demand letter, or lawsuit concerning its website’s accessibility. Cre8 My Site will make reasonable efforts to correct issues in code it wrote. All other work, including audits, expert reports, remediation of Client content or third-party tools, and time spent supporting the Client’s response, will be billed at Cre8 My Site’s then-current rates. Cre8 My Site is not responsible for the Client’s attorney’s fees, settlements, judgments, or other costs arising from any such complaint or claim, and the Indemnification section applies.
Overlay widgets. Cre8 My Site does not provide accessibility overlay widgets, because they do not make a website compliant. If the Client chooses to install one, it does so at its own discretion and risk.
IndemnificationHolding us harmless
The Client agrees to indemnify and hold harmless Cre8 My Site, its owners, employees, contractors, and partners from any and all claims, liabilities, damages, and expenses (including attorney's fees) arising from:
- Issues with the Client's website content or materials
- Third-party software failures
- The Client's failure to comply with applicable regulations or laws
- Any complaint, demand, or claim alleging that the Client's website, content, or business fails to comply with accessibility laws (including the ADA) or privacy laws
- Any breach of this Agreement by the Client
Agreement Updates & NoticeHow we communicate changes

Your continued use of our services after the notice period constitutes acceptance of the updated terms. If you disagree, you may cancel per the Termination section.

Nothing to sign on this page.
On purpose. This is the agreement published in full so you can read it before you talk to anyone about money, not a form we want you signing off a website. When you decide to start, you get the real thing, addressed to you.
Questions about any clause above? Text 985-981-6256 and you'll get a straight answer, not a sales call.
Read it here first
The whole agreement is on this page, free to read, with nothing gated behind a form or a call. If something in it is a dealbreaker, we would both rather you find that out now than three weeks in.
